We are committed to ensuring that any personal data we hold about you and your child is protected in accordance with data protection laws and is used in line with your expectations.

This privacy notice explains what personal data we collect, why we collect it, how we use it and how we protect it.

1. Definitions and Interpretation

In this Policy the following terms shall have the following meanings:

“Account” means an account required to access and/or use certain areas and features of Our Site;

“Cookie” means a small text file placed on your computer or device by Our Site when you visit certain parts of Our Site and/or when you use certain features of Our Site. Details of the Cookies used by Our Site are set out in our Cookies section, below;

“Our Site” means this website, gcdaynurseries.co.uk;

“UK and EU Cookie Law” means the relevant parts of the Privacy and Electronic Communications (EC Directive) Regulations 2003 as amended in 2004, 2011 and 2015; and

“We/Us/Our” means Goldcrest Day Nurseries Ltd, whose company information is detailed below in section 2 Information About Us.

3. Scope – What Does This Policy Cover?

This Privacy Policy applies only to your use of Our Site. It does not extend to any websites that are linked to from Our Site (whether We provide those links or whether they are shared by other users). We have no control over how your data is collected, stored or used by other websites and We advise you to check the privacy policies of any such websites before providing any data to them.

4. What Data Do We Collect?

We collect personal data about you and your child to provide care and learning that is tailored to meet your child’s individual needs. We also collect information in order to verify your eligibility for free childcare as applicable.

Personal details that we collect about your child include:

  • your child’s name, date of birth, address, health and medical needs, development needs, and any special educational needs.

Where applicable we will obtain child protection plans from social care and health care plans from health professionals.

We will also ask for information about who has parental responsibility for your child and any court orders pertaining to your child.

Personal details that we collect about you include:

  • your name, home and work address, phone numbers, emergency contact details, and family details

This information will be collected from you directly in the registration form and in the initial All About Me form

If you apply for up to 30 hours free childcare, we will also collect:

  • your national insurance number or unique taxpayer reference (UTR), if you’re self-employed. We may also collect information regarding benefits and family credits that you are in receipt of.

Other personal data that we collect on our website

  • Name;
  • Business/Company name;
  • Contact information such as email addresses and telephone numbers;
  • Demographic information such as post code, preferences and interests;
  • IP address (automatically collected);
  • web browser type and version (automatically collected);
  • operating system (automatically collected);
  • a list of URLs starting with a referring site, your activity on Our Site, and the site you exit to (automatically collected).

5. Why we collect this information and the legal basis for handling your data

We use personal data about you and your child in order to provide childcare services and fulfil the contractual arrangement you have entered into. This includes using your data to:

  • contact you in case of an emergency
  • to support your child’s wellbeing and development
  • to manage any special educational, health or medical needs of your child whilst at our setting
  • to carry out regular assessment of your child’s progress and to identify any areas of concern
  • to maintain contact with you about your child’s progress and respond to any questions you may have
  • to process your claim for up to 30 hours free childcare (only where applicable)
  • to keep you updated with information about our service

With your consent, we will also record your child’s activities for their individual learning record. This may include photographs and videos. You will have the opportunity to withdraw your consent at any time, for images taken by confirming so in writing.

We have a legal obligation to process safeguarding related data about your child should we have concerns about their welfare. We also have a legal obligation to transfer records and certain information about your child to the school that your child will be attending (see Transfer of Records policy).

6. Other Ways We Use Your Data

  • All personal data is stored securely in accordance with the EU General Data Protection Regulation (Regulation (EU) 2016/679) (GDPR). For more details on security see section 6, below.
  • We use your data to provide the best possible products and services to you. This includes:
    • Personalising and tailoring your experience on Our Site;
    • Supplying Our products and services to you;
    • Personalising and tailoring Our products and services for you;
    • Responding to communications from you;
    • Supplying you with email communications that you have subscribed to. You may unsubscribe or opt-out at any time by clicking the unsubscribe link in our email, or by emailing us via our contact page;
    • Market research;
    • Analysing your use of Our Site and gathering feedback to enable Us to continually improve Our Site and your user experience;
  • In some cases, the collection of data may be a statutory or contractual requirement, and We will be limited in the products and services We can provide you without your consent for Us to be able to use such data.
  • With your permission and/or where permitted by law, We may also use your data for marketing purposes which may include contacting you by email, telephone, text message or post with information, news and offers on Our products and/or services.  We will not, however, send you any unsolicited marketing or spam and will take all reasonable steps to ensure that We fully protect your rights and comply with Our obligations under the GDPR and the Privacy and Electronic Communications (EC Directive) Regulations 2003, as amended in 2004, 2011 and 2015.
  • Under GDPR we will ensure that your personal data is processed lawfully, fairly, and transparently, without adversely affecting your rights. We will only process your personal data if at least one of the following basis applies:
    • you have given consent to the processing of your personal data for one or more specific purposes;
    • processing is necessary for the performance of a contract to which you are a party or in order to take steps at the request of you prior to entering into a contract;
    • processing is necessary for compliance with a legal obligation to which we are subject;
    • processing is necessary to protect the vital interests of you or of another natural person;
    • processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller; and/or
    • processing is necessary for the purposes of the legitimate interests pursued by us or by a third party, except where such interests are overridden by the fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.

7. How and Where Do We Store Your Data?

  • We only keep your data for as long as We need to in order to use it as described above in section 5, and/or for as long as We have your permission to keep it. In any event, We will conduct an annual review to ascertain whether we need to keep your data. Your data will be deleted if we no longer need it.
  • Some or all of your data may be stored or transferred outside of the European Economic Area (“the EEA”) (The EEA consists of all EU member states, plus Norway, Iceland and Liechtenstein). You are deemed to accept and agree to this by using Our Site and submitting information to Us. If We do store or transfer data outside the EEA, We will take all reasonable steps to ensure that your data is treated as safely and securely as it would be within the EEA and under the GDPR. Such steps may include, but not be limited to, the use of legally binding contractual terms between Us and any third parties We engage and the use of the EU-approved Model Contractual Arrangements.
  • Data security is of great importance to Us, and to protect your data We have put in place suitable physical, electronic and managerial procedures to safeguard and secure data collected through Our Site.
  • Steps We take to secure and protect your data include:
    • use of unique passwords;
    • properly configured firewalls using latest software;
    •  user access control;
    • regular software updates
    • timely decommissioning and secure wiping of old software and hardware;
    • real-time protection anti-virus, anti-malware and anti-spyware software;
    • encryption of all portable devices and appropriate protection of encryption key;
    • encryption of personal data in transit including SSL and IPsec VPN connections;
    • secure configuration of mobile devices;
    • intrusion detection and prevention systems;
    • regular data backups
  • Notwithstanding the security measures that We take, it is important to remember that the transmission of data via the internet may not be completely secure and that you are advised to take suitable precautions when transmitting to Us data via the internet.

We also protect unauthorised access to your personal data and prevent it from being lost, accidentally destroyed, misused, or disclosed by:

  • Storing in a locked filing cabinet within the Nursery Office

8. Do We Share Your Data?

In order for us to deliver childcare services we will also share your data as required with the following categories of recipients:

  • Ofsted – during an inspection or following a complaint about our service
  • banking services to process chip and pin and/or direct debit payments
  • the Local Authority (where you claim up to 30 hours free childcare as applicable)
  • the government’s eligibility checker (as above)
  • our insurance underwriter (if applicable)
  • our setting software management provider (if applicable)
  • the school that your child will be attending

We will also share your data if:

  • We are legally required to do so, for example, by law, by a court
  • to enforce or apply the terms and conditions of your contract with us;
  • to protect your child and other children; for example by sharing information with social care or the police;
  • it is necessary to protect our rights, property or safety
  • We transfer the management of the setting, in which case we may disclose your personal data to the prospective buyer so they may continue the service in the same way.

We will never share your data with any other organisation to use for their own purposes

  • We may share your data with other companies in Our group. This includes Our subsidiaries and/or Our holding company and its subsidiaries.
  • We may compile statistics about the use of Our Site including data on traffic, usage patterns, user numbers, sales and other information. All such data will be anonymised and will not include any personally identifying information. We may from time to time share such data with third parties such as prospective investors, affiliates, partners and advertisers. Data will only be shared and used within the bounds of the law.

9. How long do we retain your data?

We retain your child’s personal data for up to 3 years after your child no longer uses our setting, or until our next Ofsted inspection after your child leaves our setting. Medication records and accident records are kept for longer according to legal requirements. Your child’s learning and development records are maintained by us and handed to you when your child leaves.

In some instances (child protection, or other support service referrals) we are obliged to keep your data for longer if it is necessary to comply with legal requirements (see our Children’s and Provider Records policies).

10. Automated decision-making

We do not make any decisions about your child based solely on automated decision-making. Or explain details if this is the case.

11. What Happens If Our Business Changes Hands?

  • We may, from time to time, expand or reduce Our business and this may involve the sale and/or the transfer of control of all or part of Our business. Data provided by users will, where it is relevant to any part of Our business so transferred, be transferred along with that part and the new owner or newly controlling party will, under the terms of this Privacy Policy, be permitted to use the data for the purposes for which it was originally collected by Us.
  • In the event that any of your data is to be transferred in such a manner, you will be contacted in advance and informed of the changes. When contacted you will not, however, be given the choice to have your data deleted or withheld from the new owner or controller.

12. How Can You Control Your Data?

  • When you submit information via Our Site, you may be given options to restrict Our use of your data. We aim to give you strong controls on Our use of your data (including the ability to opt-out of receiving emails from Us which you may do by unsubscribing using the links provided in Our emails and at the point of providing your details.
  • You may also wish to sign up to one or more of the preference services operating in the UK: The Telephone Preference Service (“the TPS”), the Corporate Telephone Preference Service (“the CTPS”), and the Mailing Preference Service (“the MPS”). These may help to prevent you receiving unsolicited marketing. Please note, however, that these services will not prevent you from receiving marketing communications that you have consented to receiving.

13. Your Right to Withhold Information and Your Right to Withdraw Information After You Have Given it

  • You may access certain areas of Our Site without providing any data at all. However, to use all features and functions available on Our Site you may be required to submit or allow for the collection of certain data.
  • You may restrict your internet browser’s use of Cookies. For more information, see section 12 Cookies.
  • You may withdraw your consent for Us to use your personal data as set out in section in 5 at any time by contacting Us using the details set out in section 15, and We will delete Your data from Our systems. However, you acknowledge this may limit Our ability to provide the best possible products and services to you.

14. How Can You Access Your Data?

You have the right to:

  • request access, amend or correct your/your child’s personal data
  • request that we delete or stop processing your/your child’s personal data, for example where the data is no longer necessary for the purposes of processing; and
  • request that we transfer your, and your child’s personal data to another person

If you have continue to have concerns about the way your data is handled and remain dissatisfied after raising your concern with us, you have the right to complain to the Information Commissioner Office (ICO). 15. Cookies

Our Site may place and access certain first party Cookies on your computer or device. First party Cookies are those placed directly by Us and are used only by Us. We use Cookies to facilitate and improve your experience of Our Site and to provide and improve Our products and services. By using Our Site you may also receive certain third party Cookies on your computer or device. Third party Cookies are those placed by websites, services, and/or parties other than Us. We use third party Cookies on Our Site for services such as email automation, customer relationship management, social media and conversion optimisation.

In addition, Our Site uses analytics services provided by Google Analytics, which also use Cookies.  Website analytics refers to a set of tools used to collect and analyse usage statistics, enabling Us to better understand how people use Our Site.
